Could mediation be right for you?

For some people facing the prospect of divorce, they are concerned that it will be a hellish experience that they want to get through as quickly as possible.  They fear that the divorce will consume them (i.e. financially and emotionally), they may believe that they will be ruined after the process is over.

But the reality is, not all divorces are the arduous, knock-down, drag out legal brawls that cost tens of thousands of dollars. This is likely because many divorcing couples want to save as much money as they can for their post divorce lives. This commonly leads them to alternative dispute resolution instead of litigation. So they use mediation to resolve disputes over property division, parenting time and support.

With that, this post will highlight a few benefits of mediation.

It is cheaper than litigation – As we alluded to earlier, there is less money spent in mediation compared to litigation. Also, one mediation session could resolve so many more issues than discovery and multiple hearings before a judge.

The parties are in control – In the same vein, the parties control the process of mediation. This means that they are not beholden to a court’s schedule and can reach agreements at their own pace.  

Preserving relationships – The main purpose of mediation is to reach a compromise. This is important because a successful co-parenting relationship is based on compromise. Conversely, litigation tends to drive people apart and the relationships that co-parents need are usually compromised when there is a winner and a loser.
