The basics of mediation

Going through the court system might seem like the obvious option for couples who are ready to end their marriages, but there is another option to calling it quits. Mediation is a form of conflict resolution that gives divorcing couples the opportunity to work out their own issues. This process is typically guided by a neutral, third-party mediator. However, this individual does not make any decisions for the couple, but instead helps facilitate the conversation.

For those who can work cooperatively, the process usually only takes days or weeks. This is compared with months or years of more traditional litigated divorce. It also involves fewer legal fees and extraneous costs than litigation, and the confidential aspect of mediation is extremely appealing for those who value their privacy. With traditional divorces, information is usually a matter of public record.

Although a litigated divorce might get more screen time in TV shows, movies and celebrity stories, mediation can be an excellent solution for many people. New Jersey couples can not only achieve a quicker and more affordable end to their marriages, but they can also do so in a manner that allows them to exercise greater control over the outcome. However, using mediation does not mean that a person has to forgo legal representation, and indeed many people choose to work with an experienced attorney during this process.
